The rules for using this website. Plain English, and short enough to actually read. Last updated September 4, 2026.

Before launch

This page is a general template, not legal advice. It has not been reviewed by an attorney, and it should be before this site goes live. Utah law, our insurance, and the way we actually run jobs may all require changes.

It also does not replace a construction contract. Nothing here governs work on your home — that is set out in the signed agreement between you and us, and that agreement always wins.

01

Accepting these terms

This website is operated by Dunham Construction LLC (“B & D Elite,” “we,” “us”). By browsing the site, using any tool on it, or sending us a message through it, you agree to these terms. If you do not agree with them, please do not use the site.

The site is meant for adults. It is not directed at children, and we do not knowingly collect information from them. How we handle the information you send us is covered in our Privacy Policy.

02

This website is information, not an offer

Everything here — service descriptions, project pages, process steps, prices, timelines, and renderings — is published to help you decide whether to talk to us. None of it is an offer, a bid, a quote, a proposal, or a contract, and nothing on this site can be accepted to form one.

Real work is only ever governed by a separate written construction contract signed by you and by us. That contract sets the scope, the price, the schedule, the allowances, the payment terms, and the warranty. Where anything on this website differs from your signed contract, the contract governs and this website counts for nothing.

03

Renderings, sample projects, and photographs

Much of the imagery on this site is illustration rather than documentation. It includes computer-generated and AI-generated renderings, stock photography, and images created to demonstrate a design idea. Images are used to show what a finished space can look like — not to represent a specific job we completed for a specific customer, unless a page says so plainly.

Before-and-after comparisons, project descriptions, square footages, durations, and budget ranges shown on project pages are illustrative of the kind of work we do. Your house is not the house in the picture. Site conditions, structure, mechanical layout, code and permitting, material availability, and your own selections all change the result.

Reviews and testimonials describe one customer’s experience and are not a promise of what yours will be. Statistics shown on the site are summaries, not guarantees of future performance.

04

Prices and the budget slider are indicative

The budget tool on this site walks a basement from unfinished up to about $100,000, with line items at each stop. Those figures are modeled on a roughly 1,000 square foot basement finish in Utah Valley at current rates. They exist to give you a sense of what each level of finish costs and what order the work happens in.

They are estimates for illustration. They are not a quote for your home, not a price guarantee, and not a commitment to perform work at any figure shown. The same is true of any price, range, or “from” figure anywhere else on the site.

A real number comes from a walkthrough of your actual space, a scope worked out with you, and a written proposal — in that order. Prices we publish can change at any time without notice.

05

The room visualizer

The visualizer lets you upload a photo of a room and see an AI-generated version of it reimagined in a style you pick. To use it, you agree to the following.

  • You must have the right to upload the photo. Only upload images you took yourself or otherwise have permission to use, of property you own or occupy or have permission to photograph. Do not upload images of other people, images you do not have rights to, or anything unlawful, offensive, or confidential.
  • Your photo is sent to a third-party AI service. We pass it to an external image-generation provider to produce the result, and we do not keep it after that. See our Privacy Policy for the detail.
  • The result is a picture, not a plan. It is an illustration generated by a model. It is not a design deliverable, an architectural drawing, a feasibility study, a structural or code assessment, or a quote. It may show finishes, layouts, or features that cannot lawfully or practically be built in your home, and it may simply be wrong.
  • No design services are being provided. Using the tool does not engage us as your designer, architect, engineer, or contractor, and creates no obligation on either side.
  • Usage is capped. Renders are limited per visitor per day, and each session gets one render plus a small number of refinements. Do not try to work around those limits, script the tool, or call it from anywhere other than this website.
  • It may be unavailable. The tool depends on a third-party service and a daily budget. We may change it, limit it, or withdraw it entirely at any time, and we do not promise it will work when you want it.

You keep whatever rights you have in the photo you upload. We do not claim ownership of it. You may keep and use the image the tool gives back for your own personal, non-commercial purposes — but AI output of this kind may not be protected by copyright, and we make no promise that it does not resemble something else or that using it infringes nobody’s rights.

06

Contacting us through the site

When you submit the contact or estimate form, the details you enter are emailed to us so we can reply. Please give us accurate information, and please do not send anything sensitive or confidential through it — email is not a secure channel.

Submitting a form, or us replying to it, does not create a customer relationship or oblige either of us to go ahead. That starts when a construction contract is signed. By giving us your phone number or email address you are asking us to contact you about your inquiry.

07

Warranty on work we actually build

Any workmanship warranty we offer — including the two-year written warranty referred to elsewhere on this site — is defined by, and limited to, the terms written into your signed construction contract. This website does not create, extend, vary, or restate it, and no warranty of any kind attaches to the site itself, its renderings, its pricing tools, or the visualizer. Manufacturer warranties on products and materials are given by those manufacturers, not by us.

08

Our content

The site and its contents — text, photographs, renderings, drawings, layout, design, graphics, and the B & D Elite Builders name and logo — belong to us or to our licensors and are protected by copyright and trademark law.

You may view the site, and print or download pages, for your own personal use in considering a project. You may not copy, republish, sell, or use our content commercially, strip our marks from it, or use it to train a machine-learning model, without our written permission.

09

How you may use the site

Please do not:

  • Use the site for anything unlawful, or to harass, defraud, or impersonate anyone.
  • Try to break, overload, or gain unauthorized access to the site, its servers, or its APIs.
  • Scrape, harvest, or bulk-download the site, or use bots or automated tools on it, without our written permission.
  • Work around any usage limit, quota, or access control, including those on the visualizer.
  • Upload anything containing malware, or anything you do not have the right to send us.

We may limit or block access to the site, or to any tool on it, at any time and without notice.

10

Links to other sites

Where we link to somewhere else — a supplier, a manufacturer, a review platform, a social account — we do so for convenience. We do not control those sites, we are not responsible for their content or their privacy practices, and a link is not an endorsement. Their terms apply once you leave here.

11

The site is provided as it is

We put real effort into keeping this site accurate and current, but we cannot promise it is. Content may be incomplete, out of date, or wrong, and the site may be unavailable or interrupted.

To the fullest extent the law allows, the site and everything on it is provided “as is” and “as available,” without warranties of any kind, express or implied — including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. Nothing on this site is legal, financial, engineering, or design advice, and nothing here should be relied on in place of a professional assessment of your own property.

12

Limitation of liability

To the fullest extent the law allows, Dunham Construction LLC and its owners, employees, and contractors are not liable for any indirect, incidental, consequential, special, or punitive damages arising out of your use of this website or anything on it — including any decision you make, or money you spend, in reliance on a rendering, a price shown here, or a visualizer result.

This limitation is about the website. It does not limit our responsibility for construction work we perform under a signed contract; that is dealt with in the contract itself. It also does not limit anything that cannot be limited by law — including liability for fraud, or for death or personal injury caused by negligence — and nothing in these terms takes away rights you have under the Utah Consumer Sales Practices Act or any other Utah consumer protection law.

You agree to cover us for claims, losses, and reasonable legal costs arising from your misuse of the site, your breach of these terms, or any content you upload that you did not have the right to upload.

13

Governing law

These terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws rules. Any dispute about this website or these terms will be brought in the state or federal courts located in Utah County, Utah, and you and we both agree to those courts hearing it. If any part of these terms turns out to be unenforceable, the rest still applies.

14

Changes to these terms

We may update these terms as the site changes. The version published here is the one that applies, and the date at the top tells you when it last changed. If you keep using the site after an update, you are accepting the new version. Material changes will not apply retroactively to anything that happened before they were posted.

15

Getting in touch
